As you probably already read in the cc
copies of documents I've sent you on this case in last 6 months, we met with SJCEHD in May
2010 and we discussed how to get this site into an ozone remediation testing phase as
there had been a lot of back-and-forth on getting RWQCB approval on it. As you may
remember, this site adjoins a BP/CP site that has been under ozone injection remediation
for 5+ years. We have previously submitted documents to SJCEHD illustrating similar
hydrogeologic conditions at the two adjacent parcels. In our meeting, we discussed with
SJCEHD several instances in which RWQCB has allowed ozone pilot-scale without ozone-bench
testing or WDR application, in the event that a detailed monitoring plan and contingency
plan are in place for the pilot testing. Stratus has done ozone pilot-scale without a WDR
permit or bench-testing at sites approved by Vera Fischer (3900 Fruitridge, Sac) and
Kristi Shelton (Ramos plant in Isleton) .
Considering the already-altered geochemical state (if it was going to happen at all) of
the subsurface by the BP/CP ozone system, SJCEHD approved us to submit a work plan for the
testing (including monitoring and contingency plans) . This work plan was submitted to SJC
and you on June 22; SJCEHD approved the work plan in a letter dated July 21 but their
approval was contingent on your approval. If you have not already reviewed the work plan
that was submitted to you in June, could you please do that and provide your input on our
proceeding when you can.
For your convenience, I have attached the docs here so you don't have to go hunting for
them. I understand this'll have to wait for your return in December - hope you have a
happy Thanksgiving!
-sarah
Sarah O.
