DOC(66 KB) r5-2008-0149_m...
Hi Sarah.
While we have in the past allowed ozone pilot studies to go ahead without issuing a
permit, we now require (and have required since last summer) submittal of the Notice of
Intent (injection permit application) and a draft Monitoring and Reporting Program (MRP in
MS Word) documents (no fee required with the NOI/MRP) to evaluate the proposal for need of
a permit. Had Stratus communicated directly with me as Vicki indicated (not just noted
an intent to wait for a response in a document that I just noticed as I was filing it this
week) months ago, you would be closer to that approval. I simply do not have the time to
just read every document sent for San Joaquin County cases and also keep up with my own
case load, so I rely on both of you to directly contact me to request a review or answer a
question.
I also noticed that hydrogen peroxide is also listed on the status report, so this is not
just an ozone test. Please fill out the attached form and return it for my review. A
draft MRP is also included (don't change the format or legal language) to assist you. I
will review both documents and provide a decision whether the pilot study may proceed
without a permit. Contact me with your questions.
Thanks Vicki and Sarah.
Jim Barton
James L.L. As you probably already read in the cc
copies of documents I've sent you on this case in last 6 months, we met with SJCEHD in May
2010 and we discussed how to get this site into an ozone remediation testing phase as
there had been a lot of back-and-forth on getting RWQCB approval on it.
