Health&Safety Code Section 25299.39.2(a)requires that the Fund Manager notify UST owners or operators who have a Letter of Commitment (LOC)that has been in active status for five or more years and to review the case history of these sites on an annual basis unless otherwise notified by the UST owner or operator. Background During the Fiscal Year 2006-2007, the LOC for your claim will have been active for five years or more. By notice of this,letter, the Fund is.informing you of its intent to review your UST case. Based on site-specific data collected during the review, the Fund may proceed with one of the following: (1) agree that the UST case continue on the current course, (2).work with the. regulatory oversight agency staff to modify the course of work to move the case toward closure, (3)make a recommendation for closure of the case to the regulatory oversight agenby, or(4) if necessary,present the case to the State Water Resources.Control Board(State Water Board) for closure. Action Reciuested You must notify this office in writing, no later than thirty (30) days from the receipt of this letter, should you choose not to have your case reviewed. Following our review of your claim, you will be notified should it be determined that your UST case is a candidate for closure.
