, 1 <br /> Item No . <br /> PC : 5-7-87 <br /> MS-87-42 <br /> Page 3 <br /> STAFF ANALYSIS <br /> BACKGROUND : <br /> The Map of the Town of Evergreen was recorded on May 2 , 1888 . It <br /> contained 350 small residential lots and numerous streets and <br /> alleys . The applicant is the present owner of the eastern 20 <br /> acres of the Town of Evergreen. He submitted a copy of the map <br /> and requested a determination of the map ' s validity. After con- <br /> ferring with the Surveyor ' s Office and County Counsel , it was <br /> dediced that the map was still valid and, therefore , contained <br /> recognizable parcels . The applicant was advised that he could <br /> file a Minor Subdivision application to create four parcels by <br /> reconfiguring the existing lots of the Town of Evergreen. <br /> The Planning Division approved the applicant ' s Minor Subdivison <br /> Application No . MS-87-42 on March 9 , 1987 . The approval was <br /> appealed by two neighboring property owners on March 20 , 1987 . <br /> BASES OF APPEAL : <br /> The appellants contend that the Minor Subdivision application <br /> should be denied based on the following reasons : <br /> 1 . The area is zoned GA-40 ; therefore, four parcels are substan- <br /> dard. <br /> 2 . No notices on the proposed zoning were sent out , and no <br /> public hearing was held on the proposed division. <br /> 3 . The proposed subdivision will have an adverse effect on agri- <br /> culture in the area. <br /> 4 . The Map of the Town of Evergreen is not correct and is not an <br /> official map. <br /> 5 . The subdivision is poorly designed because it allows a parcel <br /> with only 25 feet of frontage along Alpine Road. <br /> 6 . Other property owners in the area should be given the same <br /> privilege to subdivide if this subdivision is approved. <br /> ANALYSIS OF APPEAL : <br /> 1 . The area is zoned GA-40 , and normally, a subdivision creating <br /> three three-acre parcels and a ten-acre parcel would not be <br /> allowed. However , in this instance , staff felt the recon- <br /> figuration of the applicant ' s portion of the old Map of <br />
