NRC Equity Fund 1 <br /> On May 21st, 2019, the Board of Supervisors voted to remove the section requiring <br /> a tax and replace it with a requirement that commercial cannabis businesses obtain <br /> a Development Agreement. The Board also voted to direct staff to bring back an <br /> amendment to remove the allowance for retail storefronts; the allowance for retail <br /> sales through delivery service remains. <br /> Under the new ordinance, commercial cannabis business types are allowed in the <br /> unincorporated areas of the County so long as they comply with the operative <br /> ordinances: Title 4, Division 10, Chapter 1 Commercial Cannabis Business and the <br /> corresponding Title 9, Division 10, Chapter 9-1090 Commercial Cannabis. <br /> Consent of Landowner (Land Use Permit Application Package, Page 5 of 16) has <br /> been executed by the Landowner and is part and parcel of this submittal. <br /> 1.3 Land Use Permits <br /> Pursuant to Amendment to Title 4, Division 10, Chapter 1, Commercial Cannabis <br /> Business, all commercial cannabis use types (Cannabis Cultivation, Cannabis <br /> Distribution, Cannabis Manufacturing, and Cannabis Laboratory Testing requires an <br /> approved Commercial Cannabis Development Agreement ("DA"). <br /> Commercial cannabis industry models that could potentially be permitted in a <br /> Cannabis Business Park may be conditionally approved with a Special Purpose Plan <br /> ("SPP") in a zone(s) where the commercial cannabis related uses are permitted. <br /> When a Cannabis Business Park is approved for a property by way of a SPP, <br /> additional discretionary land use approval for businesses within the Cannabis <br /> Business Park are not required and may be permitted with a ministerial <br /> Improvement Plan application. <br /> 1.3.1 Cannabis Business Park <br /> A contiguous area with an approved Special Purpose Plan pursuant to Title <br /> 9, Division 8, Chapter 9-815 of this Code that is specially designated, <br /> designed, and landscaped to safely allow and accommodate Commercial <br /> Cannabis Licensees in compliance with this Chapter and State law. <br /> 1.3.2 Limitation on use (Cannabis Cultivation) <br /> Title 4 Commercial Cannabis Business ordinance allows for Commercial <br /> Cannabis businesses to operate in the unincorporated areas of the County <br /> subject to, a Board approved DA and in the case of the Applicant herein, a <br /> SPP; a SPP includes but is not limited to property zone designation, type <br /> of development project, a Commercial Cannabis License issued by the <br /> Environmental Health Department, and an Annual State License. <br /> Page 7 1 54 <br />
