WASTE DISCHARGE REQijIREATS ORDER NO.99-079 • -5- <br /> NESTLE USA-BEVERAGE DIVISION INC. <br /> RIPON FACILITY <br /> SAN JOAQUIN COUNTY <br /> C. Provisions: <br /> 1. The Discharger shall comply with the attached Monitoring and Reporting Program No. 99-079. <br /> 2. The Discharger shall submit a 6 month Pilot Test Summary Report summarizing the results <br /> of the 6 month study, including an evaluation of the effectiveness of using potassium <br /> permanganate to supplement the full-scale remediation of VOC contaminated groundwater at <br /> the facility,the impact of any by-products on the receiving groundwater,the hydraulic <br /> properties on the aquifer, and any other effeus the in-situ treatment may have. <br /> 3. The Discharger must comply with all conditions of this Order, including timely submittal of <br /> technical and monitoring reports as directed by the Executive Officer. Violations may result <br /> in enforcement action, including Regional Board or court order requiring corrective action or <br /> imposing civil monetary liability, or in revision or rescission of this Order. <br /> 4. The use of the chemical potassium permanganate shall not cause pollution or nuisance as <br /> defined by the California Water Code, Section 13050. <br /> 5. The Discharger shall provide an alternate water supply source to the City of Ripon or to any <br /> well owner if the Potassium Permanganate Pilot Study, including the chemical by-products, <br /> adversely affect any water supply wells. <br /> 6. Should the evaluation of the pilot test data reveal adverse effects upon beneficial uses, upon <br /> determination by the Executive Officer,the Discharger shall cleanup and abate the effects of <br /> discharging potassium permanganate including extraction of any by-products and shall <br /> provide an alternate water supply source for any municipal, domestic or other water use well <br /> that, are impacted above water quality objectives as a result of using potassium permanganate. <br /> I, GARY M.
