We requested that you complete soil vapor <br /> extraction (SVE)testing and submit the results by 1 October 2001 in a Final Remediation Plan (FRP). To date, <br /> the plan of work has not been implemented, and we have not received the requested FRP. <br /> Due to non-compliance with San Joaquin County Environmental Health Division(County) directives, the County <br /> referred this site to us in August 2000, and we issued our Water Code Section 13267 directive to you on <br /> 28 August 2000 requiring you to submit a plan of work to complete the soil and groundwater investigation <br /> relating to the former underground storage tanks (USTs) at the subject site. The initial workplan was submitted <br /> as required;however,you have not shown a good faith effort to continue this investigation. <br /> We recently received correspondence from the UST Cleanup Fund that the pre-approval request for the SVE <br /> testing and preparation of the FRP was submitted to them on 17 September 2001 (88 days following our <br /> workplan approval). Please note that site work is not stipulated on pre-approval and it is inappropriate to <br /> disregard regulatory deadlines while applying or waiting for pre-approval. <br /> You must complete the SVE testing forthwith and submit the required FRP. Please acknowledge this letter by <br /> submitting a schedule for work at your site. By 31 October 2001, submit a schedule to this office to install the <br /> necessary SVE wells,complete the SVE testing, analyze air samples, and submit the FRP. <br /> Failure to comply with these requests may subject you to formal enforcement actions including monetary civil <br /> liability, and may affect future reimbursements from the UST Cleanup Fund. Please notify me at least five <br /> business days prior to any ite work.
