Mossdale Ave in Lathrop,three Aboveground Storage <br /> Tanks(AST)were observed that may be of concern. One of the tanks has a stated storage capacity of 6,000 gallons and <br /> two have a stated storage capacity of 5,000 gallons.The 6,000 gallon tank and one of the 5,000 gallon tanks are storing <br /> diesel. One of the 5,000 gallon tanks was stated to not be in use,under Aboveground Petroleum Storage Act(APSA)and <br /> Spill Prevention,Control,&Countermeasure(SPCC) regulations,the tank is considered active until certain steps are <br /> taken to close the tank.The three aboveground storage tanks don't appear to meet the emergency venting <br /> requirements required by fire code and they do not have permanent support saddles. Based upon different encounters <br /> with these types of tanks,this may be an indication that the tanks were at one point Underground Storage Tanks(UST). <br /> During the paperwork review there a Periodic Integrity Test Certificate was found which indicates that one of the tanks <br /> is an unbranded UST.The size of the tank is described as 8,000 gallons and the material being stored is diesel and no UL <br /> 11 was on the tank.The tank is described as having an open metallic dike.The plan SPCC plan that was reviewed does not <br /> mention an 8,000 gallon tank,but the facility stated that the certificate was for one of the tanks.They have not added or <br /> removed tanks since the 2017 test certificate. <br /> In doing some research,California State Fire Marshal Information Bulletin 14-005 was found,which prohibits USTs being <br /> used as ASTs. The bulletin references Section 5704.2.7,of the California Fire Code.The bulletin and its addendum are <br /> attached along with pictures of the tanks. We would like to make you aware of these potential fire code violations since <br /> our department does not have the authority to enforce these Fire Code. <br /> The facility was issued violations under APSA based on the certificate that was provided.The violations can be cleared if <br /> your department determines that these tanks are legal tanks.
