4 <br /> PLANNING COMMISSION MINUTES <br /> SEPTEMBER 17 , 1987 <br /> 3 . MINOR SUBDIVISION APPLICATION NO. MS-88-3 OF G. CHARLES JAGIR for <br /> an appeal by William Brodbeck and Diane Oren, et al, of the Planning <br /> Division's action to approve MS-88-3 to subdivide a 47-acre parcel <br /> into two parts of 2 . 0 and 45 acres. The property is located on the <br /> northwest corner of Mettler Road and Ham Lane, south of Lodi. <br /> (Supervisorial District No. 4 ) <br /> Senior Planner Dom De La Torre introduced a staff report into the <br /> record. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Charles Jagir was present. He said that on his 45 acre <br /> parcel he has been farming 10 acres in watermelons and 18 acres in <br /> alfalfa. He said he applied for this lot split in accordance with <br /> ordinance regulations. He also said that the majority of the people <br /> in the area do not object to his division. One of his partners is a <br /> brother who lives in Sacramento and owns 20 acres of land. Another <br /> partner is an owner of a convenience store in Stockton. Mr. Jagir <br /> said he is a full-time school teacher and has a license to sell real <br /> estate. His proposal is to build his home on the 2-acre parcel. He <br /> needs the division for financing purposes. He does not want to <br /> encumber the rest of his land. He has other rental properties but his <br /> only collateral for the loan for his house would be the 2-acre parcel. <br /> It is necessary for him to live on his farm in order to protect it <br /> from theft and vandalism. He is not going to further subdivide the 45 <br /> acre parcel. <br /> Khalid Jafri, owner of adjoining 40 acres, said he is an electrical <br /> engineer and also farms his land. He said he has an employee to help <br /> him. Mr. Jafri said he might like to have a subdivision of his pro- <br /> perty and would not like to have the denial of Mr. Jagir ' s proposal <br /> stand as a precedent. <br /> Russell Scott, owner of property across the street from the subject <br /> property, spoke in favor of the project. He said there is no question <br /> that Mr. Jagir is a farmer. Mr. Jagir is out working at 5 : 00 a.m. and <br /> works in the evening until dark. Mr. Jagir does his own irrigation <br /> work. In answer to a question, Mr. Scott said he was born and raised <br /> on his land. <br /> Elliott Chambers, 2014 Mettler Road, spoke in favor of the division. <br /> He said that Mr. Jagir has indicated that he does not intend to sell <br /> the land, but does intend to farm and needs the division for financing <br /> a home. <br /> Gary Merin, N. Ham Lane, Lodi, spoke in favor of the project. He said <br /> has lived on his 3 acre parcel for 2 years. Mr. Merin said he was <br /> PC: 9/17/87 -4- MINUTES <br />
