1 <br /> i <br /> Senior Planner Dom De La Torre noted that staff had received 17 let- <br /> ters in opposition to the proposal. <br /> Mrs. Vernon Brunson, Mettler Road, said she was skeptical about the <br /> proposal to split the land. She said she felt it would start a <br /> precedent for further splits. She said she did not object to <br /> construction of a residence on the property. <br /> REBUTTAL: Mr. Jagir said he met with many of the people in the area. <br /> He said he wants the same right to raise his children on his property <br /> as others have. Mr. Jagir commented that Mr. Herrmann and his father <br /> own 20 acres of land, but that he had never seen Mr. Herrmann work on <br /> the farm. Mr. Jagir said that the ordinance allows this split. He <br /> has no collateral for the residence without the split. He said he has <br /> borrowed money to buy property (his rentals ) . <br /> PUBLIC HEARING CLOSED <br /> Comm. Carter spoke on The Constitution and rights of freedom and <br /> privacy. <br /> Comm. Gabbard said he remembered this proposal from the time before <br /> and at that time he was against it. However, Mr. Jagir has proven to <br /> him that he is an owner/operator and is entitled to this split. Comm. <br /> Gabbard said that, in all good conscience, he could not deny the <br /> split. <br /> Comm. Morri said he also felt that Mr. Jagir is an owner/operator. <br /> Chairman Jungeblut said he felt that if Mr. Jagir is granted this <br /> division he would become a farmer if he is not already one. Mr. Jagir <br /> will have to spend day and night on that ranch. Mr. Jagir will be <br /> living on the property and will be able to manage it more efficiently. <br /> Mr. Jagir has indicated that he considers himself to be an <br /> owner/operator at this time. <br /> Comm. Bozzano said that the Commission has to give the applicant the <br /> benefit of any doubt. <br /> MOTION: Moved, seconded (Carter-Rojas ) and carried by a unanimous <br /> roll call vote to: <br /> 1. Affirm the Negative Declaration filed for the project. <br /> 2 . Deny the appeal filed on MS-88-3; and <br /> 3 .
