C(DIPY Acampo,CA. 95220 <br /> Attn: Stan Siefert <br /> RE: Complaint No. 90-2072 <br /> A complaint has been received by this office regarding your handling/disposal of waste oil. <br /> Waste oil is considered a hazardous waste in the State of California pursuant to Title 22, California <br /> Administrative Code, Section 66680, because it is likely to contain a hazardous material (for example; <br /> heavy metals, polychlorinated biphenyls (PCBs) etc.). Any disposal of waste oil must be managed in <br /> accordance with the generator requirements outlined in Title 22 of the California Administrative Code, <br /> Article 6, unless a waste analysis is performed verifying no hazardous constituents are present. A <br /> detailed waste analysis is a costly procedure. Therefore, to attempt classification of waste oil as non- <br /> hazardous is generally an unreasonable management method. <br /> To dispose of waste oil in storm drains, sanitary sewer systems or to the land is illegal and may result <br /> in the taking of enforcement action by the California Department of Health Services, Toxic Substance <br /> Control Division. Substantial penalties can result from failure to comply with the law. <br /> If you are a residence, you are exempt for the generator requirements outlined below. There are <br /> many recycling centers available to properly look in the Yellow Pages of the telephone book under <br /> "Recycling Facilities" or call this office. <br /> If you are a business, you must achieve compliance with State regulations as a waste oil generator and <br /> comply with the following: <br /> 1. Store waste oil in leak-proof containers. Waste oil may not be stored for longer than <br /> ninety (90) days without a storage permit or a variance from the California Department <br /> of Health Services, Toxic Substance Control Division, to store waste in excess of the 90 <br /> day limit. <br /> 2. Label the waste as follows: <br /> "Waste Oil" <br /> (Name of the Company) <br /> Start of accumulation date: MM/DD/YR <br /> (ie, the date you began to fill the container) <br /> A Division of San Joaquin County Health Care Services <br />
