On February 1.3, 1997 the State Hoard issued a technical.report which <br /> concluded that closure and issuance of a"no further action"letter is justified;; The report <br /> states:"There is no identified,reasonable water quality benefit to be gained by further <br /> exploration, monitoring, or analysis of the decades-old release at the Togo's site." The State <br /> Board transmitted the technical report to the Regional Boardon February 18, 1997 and <br /> invited the Regional Board to comment. The Regional Boaid provided comments on March <br /> 411 1997 in which it reiterated its previous position but failed to provide the State Board with <br />�--- xany flew-ir►formatiowt fin Api l 7, 99.'1 the:State Boar again�ccnciudwc3 that"the-facts of the <br /> case justify closure,of the site:" j <br /> The dispute resolution process has now concluded. All interested parties<and <br /> agencies have hadmultipleopportunities to be heard, and the State Board has upheld the <br /> County's decision to close the site. Accordingly, on behalf of all'parties to the tentative <br /> litigation settlement,we respectfully request that the County officially close the Togo's site, <br /> and issue a letter confirming that no further regulatory action is required,without further <br /> delay.
