("Texaco') hereby submits the enclosed <br /> closure report for the site located at 305 S. Hutchins Street in Lodi, in compliance with your <br /> recent request. With this submittal, Texaco again requests that San Joaquin County grant <br /> conditional closure for this site, in accordance with our prior meetings with your office. As <br /> discussed further below, time is of the essence due to pending litigation over this site in <br /> federal court, and we would appreciate your prompt attention to this matter. <br /> I. BACKGROUND <br /> In a letter to you dated May 22, 1996, I requested that San Joaquin County <br /> grant conditional closure of the site. The history of this matter is fully described in that <br /> letter. In summary, representatives of the FDIC, Texaco and ARCO met with Diane Hinson, <br /> then the Supervisor of the PHS-EHD Site Mitigation Unit, on January 22, 1996. At the end <br /> of that meeting, the following agreements with Ms. Hinson were reached. First, Ms. Hinson <br /> stated that the County would not require any remediation of petroleum hydrocarbons in the <br /> groundwater beneath the site under any circumstances. This commitment was due in part to <br /> the existing solvent contamination in that same groundwater, which is part of a regional <br /> solvent plume completely unrelated to the gasoline station operations at the site.
