Third, Ms. Hinson stated that the County <br /> would grant conditional closure of the site immediately, without the need for any further soil <br /> remediation. My May 22, 1996 closure request was consistent with the agreements reached <br /> with Ms. Hinson. <br /> II. COUNTY'S REQUEST FOR ADDITIONAL INFORMATION <br /> In response to my closure request, on June 7, 1996 you requested additional <br /> information. Specifically, you asked Texaco to provide a closure report which would <br /> provide the information identified in Appendix B of the Tri-Regional Board Staff <br /> Recommendations for Preliminary Investigation and Evaluation of Underground Tank Sites <br /> (March 1, 1994), as well as a cumulative data table for groundwater information, 2nd or 3rd <br /> quarter 1996 sampling results, and a calculated model capable of demonstrating that the <br /> residual petroleum impacted soils still in place will not further degrade groundwater in the <br /> future. <br /> In response to your letter, Texaco retained Mr. Randolph Stone, a <br /> hydrogeologist, to prepare the closure report and associated information which you <br /> requested. I understand that Mr. Stone spoke with you on several occasions regarding such <br /> matters as the exact nature of the information you were seeking, acceptable computer models <br /> and modeling parameters, etc. <br /> Mr. Stone's closure report, which contains all of the information you <br /> requested, is enclosed in triplicate for your review. As you will see, Mr. Stone concludes <br /> based on computer modeling that leaching of fuel hydrocarbons from the subsurface soils <br /> into underlying groundwater is not likely to occur. He also concludes that nearby water <br /> supply wells have not been affected by the site, that the fuel leak source has been removed <br /> from the site, and that the contaminant plume is stable. As a result, Mr. Stone states that <br /> based on the technical data, conditional closure is appropriate. <br /> III. STATUS OF PENDING LITIGATION <br /> As indicated in my May 22 letter, several parties are in litigation in United <br /> States District Court regarding this site. Based on the agreements reached with Ms. Hinson <br /> in January, the parties reached a tentative settlement which was incorporated in an Order <br /> issued by the Court in April. Under the terms of that Order, the parties agreed to pursue <br /> conditional closure under the terms agreed to by Ms. Hinson, and Texaco was directed to <br />
