Michael Infurna <br /> Diane Hinson <br /> ` October 18, 1995 <br /> Page 3 <br /> 1926 through 1933 Union Oil Company leased the Togo's site and operated a <br /> gasoline service station between 1945 to 1957 <br /> The underground storage tank system used by ARCO and then Union <br /> was located at the northeast portion of the Togo's site, beneath the present <br /> location of the Togo's building ("first generation UST system") See PAR, <br /> page 4 and Figure 2) The location of the first generation UST system has <br /> been confirmed in correspondence by counsel for Unocal V <br /> Douglas Oil Company purchased the Togo's site in 1957 Soon after <br /> purchasing the site, Douglas reconfigured the service station and installed a <br /> new set of USTs at the southern portion of the Property ("second generation <br /> UST system")(See PAR, page 4 and Figure 2) Douglas operated a service <br /> station at the site, including the second generation UST system, until 1971 <br /> Texaco, Inc (successor to Texaco Refining and Marketing, Inc ), <br /> purchased the Site from Douglas in 1971, and continued to operate a gasoline <br /> service station at the site, including the second generation UST system, from <br /> 1971 to 1979 Records indicate that Texaco excavated the second generation <br /> UST system in 1979 and sold the Property in 1981 No soil or groundwater <br /> samples were collected during the UST removal, but it was reported by a <br /> Texaco representative that the excavated soil was allowed to aerate at the site <br /> for several months In 1981, the Property was developed as a restaurant site <br /> and has been operated as a restaurant ever since <br /> City Thrift and Loan acquired the Site on November 2, 1994, pursuant <br /> to a Trustee's Deed Upon Sale FDIC involuntarily acquired the Togo's <br /> Property in 1993 as the result of the failure of City Thrift and Loan, long after <br /> the gasoline service facility had ceased operating and the site had been <br /> converted to a restaurant Clearly, City Thrift and FDIC had no role in <br /> contributing to the historical contamination at the Property <br /> 2 In our letter to you dated October 9, 1995, we included photographs of <br /> the Togo's site dated October 1956 which were produced to FDIC during the <br /> course of the litigation You will note that this photograph depicts a service <br /> station structure, automobile repair bay, and fuel dispensers located at the <br /> northeastern portion of the site <br /> s <br /> DOWNEY BRAND SEYMOUR & ROHWER <br />
