k'q KLEINFFLDER CLIENT RESPONSIBILITIES AND ASSUMPTIONS This scope of work and preliminary cost estimate are based on the following assumptions and responsibilities: • Wilbur-Ellis Company will assist Kleinfelder in obtaining access to the site and owner authorization for the proposed services. - • Adequate work space and access will be provided. Kleinfelder will attempt to advance soil borings and collect samples at the proposed locations. If the equipment cannot be positioned, alternative drilling locations or sampling methods should be investigated. • The borings are to be advanced using direct push methods. If difficult conditions are encountered, alternative sampling methods may be necessary. The borings will be backfilled in accordance with San Joaquin County PHS/EHD guidelines. • It will be the responsibility of Wilbur-Ellis Company to supply past environmental reports of the subject site. Kleinfelder will not be responsible for reports or omissions from reports not forwarded to Kleinfelder for review. • Soil and water generated during sampling will be the responsibility of the client. Soil cuttings and investigation-derived water will be left on site. Sampling and analysis of the contained soil and water may be necessary prior to disposal. Disposal or remediation options for the soil and water can be assessed once analytical results have been received. Kleinfelder is prepared to assist the client and to remediate or dispose of stockpiled soil and water, if requested. Due to the use of direct push methods, it is likely that minimal investigation derived waste will be generated. • This proposal is based on the presumption that the client will clearly mark utilities and will provide any and all available survey maps or other data to determine the location of existing structures, underground utilities and services. Wilbur-Ellis Company should be aware that penetrating the site's surface is inherently risky. It is impossible to determine with certainty the precise location of all structures, which may be buried in the ground. Kleinfelder's fee is not adequate to compensate for both the performance of the services and the assumption of risk of damage to such structures. Disruption of utilities or damage to underground structures will be the responsibility of Wilbur-Ellis Company. Services rendered by Kleinfelder to repair them will be billed at cost. Underground Service Alert (USA) at 1-800-642-2444 provides a partial location service free of charge for major utility lines. It is important that Wilbur-Ellis Company understand that subsurface utilities buried under private property will not be marked by the public utility companies contacted by USA.
