Depending on the circumstances, <br /> the farm tank exemption may or may not be allowed. Four cases of ownership <br /> or land use changes are discussed below: <br /> 1. Change in ownership but no change in usage (exempt): <br /> In this case, the ownership of the site changed but the tank remains a <br /> farm tank and the motor vehicle fuel stored in the tank continues to be <br /> used for agricultural purposes. <br /> 2. No change in ownership or land use but there are changes in tank usage <br /> (not exempt): <br /> In this case, the owner retains responsibility for the tank, but has <br /> changed or discontinued its usage. The motor vehicle fuel stored in <br /> the tank was used for agricultural purposes which allowed the tank to <br /> be exempt until the owner changed the usage. Now the tank is no longer <br /> being used for the purposes which allowed it to be exempt. <br /> -' - - -- 3. No change in ownership, but there are changes iri land-use-and motor <br /> vehicle fuel usage (not exempt): <br /> In this case, the tank owner remains the same, but the property changes <br /> from agricultural to nonagricultural use and the motor vehicle fuel <br /> stored in the tank is no longer being used for agricultural purposes <br /> (example: a farmer subdivides his property to build houses) . <br />
