AUG 14 1990
i.
4. Changes in ownership and land use (not exempt) :
In this case, both the property ownership and land use of the former.
farm tank site changed. The land use has changed from agricultural to
nonagricultural use and the motor vehicle fuel stored in the tank is no
longer being used for agricultural purposes (example: a farmer sold
his property to a developer for nonagricultural development).
All previously exempt farm tanks, if no longer being used for the purpose
which allowed them the exemption, shall be permitted or closed in accordance
with Chapter 6.7 of the Health and Safety Code. The owner of a farm tank
which becomes nonexempt must either obtain a valid operating permit or close
the tank in accordance with Chapter 6.7 of the Health and Safety Code and any
applicable local agency requirements. If a permit is required, an
application therefore should be submitted promptly and must be submitted
within the time period established by the local agency or, if no such time
period has been established, within a reasonable period of time. An
application submitted within 30 days after loss of the exemption will be
considered to be submitted within a reasonable period of time.
Local agencies may oversee UST leak cleanup pursuant to Chapter 6.7 of the
Health and Safety Code if the tank is nonexempt, or may refer the cleanup to
the Regional Water Quality Control Board regardless of the exemption status
of the tank.
If you have any questions concerning this matter, please call David Holtry at
(916) 739-4436 or call Patrick Lam at (916) 739-4324.
Sincerely,
Mike McDonald, M nager
Underground Storage Tank Program
cc: Standard Distribution h
