The following is an itemized list of hazardous materials violations that have not been <br /> addressed for BURGER KING as of February 28, 2020. <br /> Open violations from January 17, 2020 inspection <br /> Violation #2 - Failed to complete and electronically submit a hazardous materials business plan. <br /> The facility's business plan was not submitted electronically to the California Environmental Reporting System <br /> (CERS) for 2020. As of January 1, 2013, all businesses were required to submit all business plans electronically. <br /> Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to <br /> the EHD for approval. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#3 - Failed to establish and implement a hazardous materials business plan. <br /> A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business <br /> Plan shall be established and implemented for emergency response to a release or threatened release of a <br /> hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for <br /> materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and <br /> pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> enter the required information, and submit for review by the EHD. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#8 -Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program has not been submitted for 2017, 2018, 2019, and 2020. Training programs for all employees <br /> and annual training, including refresher courses, shall include familiarity with the facility's Emergency response <br /> plans and procedures in the event of a release or threatened release of a hazardous material. Training shall cover, <br /> but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Page 1 of 3 <br />
