The following is an itemized list of hazardous materials violations that have not been addressed for BURGER KING as of February 28, 2020. Open violations from January 17, 2020 inspection ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#9 - Failed to annually review and certify that the business plan is complete, accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by January 15 for 2017, 2018, 2019, and 2020. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation #11 - Failed to provide or document initial and/or refresher training to appropriate personnel. Documentation showing the required training has been accomplished was not available at the time of inspection. The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years.
