WASTE DISCHARGE REQUIREMENTS <br /> UNITED STATES ARMY CORPS OF ENGINEERS AND THE PORT OF STOCKTON <br /> STOCKTON DEEP WATER SHIP CHANNEL AND TURNING BASIN MAINTENANCE DREDGING PROJECT <br /> MILE 36.5 TO MILE 41.0 <br /> SAN JOAQUIN COUNTY -2- <br /> 7. The Corps conducted chemical and physical testing of sediments within t; :: ship <br /> channel to be dredged. The sediment analysis show that the dredging or ation <br /> (including disposal of dredged sediments) , when following this Order, laould <br /> pose a minimal threat to water quality. <br /> 8. The beneficial uses of the San Joaquin River are municipal , industrial , and <br /> agricultural supply; recreation; esthetic enjoyment; ground water recharge; <br /> fresh water replenishment; navigation; fish spawning and migration; and <br /> preservation and enhancement of fish, wildlife, and other aquatic resources. <br /> 9. The beneficial uses of the ground water are municipal , industrial , and <br /> agricultural supply. <br /> 10. The Board, on 31 March 1991, adopted a Water Quality Control Plan, Second <br /> Edition, for the Sacramento-San Joaquin River Delta Basin (5B) (hereafter Basin <br /> Plan) which contains water quality objectives for all waters of the Basin. <br /> These requirements implement the Basin Plan. <br /> 11. The State Water Resources Control Board adopted the "California Inland Surface <br /> Waters Plan" and the "California Bays and Estuaries Plan" (Plans) on 11 April <br /> 1991 . The Plans include water quality objectives and other requirements and <br /> these requirements are consistent with the Plans. <br /> 12. The Port of Stockton adopted a Class I Categorical Exemption as an existing <br /> facility in accordance with the California Environmental Quality Act (Public <br /> Resources Code Section 21000, et seq.) , and the State Guidelines. The Corps <br /> has prepared an Environmental Assessment for the Project to supplement their <br /> original Environmental Assessment prepared for previous dredging of the <br /> channel . The Board has reviewed the documents and compliance with these <br /> requirements will mitigate or avoid any significant impacts on water quality. <br /> 13. This discharge is exempt from the requirements of Section 2511(b) , Chapter 15 <br /> Division 3, Title 23, of the California Code of Regulations (CCR) . The <br /> exemption is based on the following: <br /> a. The Board has issued waste discharge requirements. <br /> b. The discharge is in compliance with the applicable Water Quality Control <br /> Plan, and <br /> C. The wastewater does not need to he managed according to Chapter 30 of <br /> Division 4, Title 22, as a hazardous waste. <br /> 14. The Board has notified the Dischargers and interested agencies and persons of <br /> its intent to prescribe waste discharge requirements for this discharge. <br /> 15. The Board, in a public meeting, heard and considered all comments pertaining to <br /> the discharge. <br />
