Stockton, California 95205 J-OAQWN 1�L��,VIV1 COUNTY Attention: Harry Islas, Associate Planner NG DIVISIOP, RE: Application No. UP-89-5 Steve Coldani, Owner; Don Hall, Agent Dear Mr. Islas: Regarding the above entitled application, please refer to Part B, Item 4, (on page 8) , which requests a description of the existing drainage courses or eroded areas on or near the project site, (e.g. , drainage ditches) . We note the applicant responds in this manner: "Drainage ditch north side of site. Drains under I-5 to evaporation ponds located on the Coldani Ranch. See attached letter pertaining to drainage rights". We have reviewed copy of said attached letter that was written by Laura E. Bainbridge, Attorney at Law. We call attention to the first part of her letter in which she states Mr. Coldani has requested her to provide information regarding his rights with respectto the culvert that goes underneath I-5 at the southern end of his property. Apparently someone has altered the first line of the first paragraph of the letter to the extent the word "culvert" was changed to "culverts"; "goes" was changed to "go"; and "southern" was crossed out, and "northern" was written. None of the changes were initialed. The Bainbridge letter may very well be describing the crosdng Mr. Coldani has at the southern part of his property; but would not be applicable for this particular drainage ditch at the northern end of the site, as shown on the attached sketch of the Use Permit Application that was prepared by Baumbach and Piazza. The culvert crossing under I-5 at the northern end of the Coldani property was constructed for Woodbridge Irrigation District by the State, through an agreement, at the time I-5 was built to accommodate this District's drainage facilities and right of way for drainage. It then follows, in the year 1983 the Coldani family wanted to memorialize their agreement respecting the disposition of this District's rights for drainage on their property; and an a^reement and grant of easement was executed on June 27, 1983, and recorded on July 26, 1983.
