Lower Sacramento Road " ' '' ' '• -n,jNS <br /> Lodi, CA. 95240 �, <br /> 1��3 JUL 26 PH 2: 03 <br /> RECORDEO /J `EOUEST Of <br /> .lEB1GAT1p11!_.AIS�R�C�-- <br /> F E E FUMPURpU-9E <br /> AGREEMENT AND GRANT OF EASEMENT <br /> THIS AGREEMENT made and entered into this <br /> 1'Hay of June , <br /> 1983 , by and between MARIA COLDANI WINNBURG and CAROL COLDANI MARCHBANK <br /> dealing with their sole and separate property, and RAY COLDANI and <br /> BARBARA COLDANI, his wife, hereinafter called "OWNERS" , and WOODBRIDGE <br /> IRRIGATION DISTRICT, duly organized and existing under and by virtue <br /> of the Laws of the State of California, hereinafter called "DISTRICT, " <br /> W I T N E S S E T FI : <br /> WHEREAS , the "DISTRICT" owns and operates a system of canals <br /> for the furnishing of irrigation water to the farm lands within its <br /> service area, and <br /> WHEREAS , by reason of such irrigation, accumulated spill water <br /> is conveyed away for disposal, and <br /> WHEREAS , the "OWNERS" own the land described on Exhibit "A" <br /> attached hereto and made a part hereof, and <br /> WHEREAS, for many years , the "DISTRICT" has had an easement to <br /> convey spill water to and over the lands of the "OWNERS" and for many <br /> years has been, and now is , discharging spill water on said lands, <br /> and <br /> WHEREAS , the parties desire to memorialize their agreement <br /> respecting the conveyance and disposition of said spill water, <br /> NOW, THEREFORE , IT IS AGREED as follows : <br /> 1. The "OWNERS" do hereby grant to the "DISTRICT" an easement <br /> to convey and dispose of its spill water from the District ditch. <br /> Said easement is located as follows : <br /> Beginning at a point located at the entrance to a culvert <br /> near the intersection of the East right of way line of <br /> Thornton Road and South right of way line of DeBroggi Road, <br /> which point is more particularly described as being within <br /> the Northeast Quarter of Section 14, Township 3 North, <br /> Range 5 East, M.D.B. & M. , and located South 14°46 '48" East, <br /> a distance of 109.95 feet from a 3/4" diameter iron pin <br /> marking the Southwest corner of Parcel A as shown on that <br /> certain Parcel Map filed in Book 6 of Parcel Maps , at Page <br /> 183, San Joaquin County Records , and continuing from said <br /> point westerly through a culvert under Thornton Road into <br /> an existing ditch immediately South of the abandoned Western <br /> Pacific right of way, and continuing Westerly through a <br /> culvert under Highway I-5 to the lands of the "OWNERS", <br /> described on Exhibit "A", on the West side of Highway I-5 . <br /> 2. The "OWNERS" will accept said spill water at the above <br /> described point on the East side of Thornton Road and be responsible <br /> for its conveyance to and disposition on the West side of Highway I-5. <br /> This is a covenant running with "OWNERS "' land in perpetuity, or so <br /> long as the "DISTRICT" conveys water to said point. <br /> -1- <br />
