1.137 "13%r Discount Debenture Stock Interests" means the Old SFC-NH Common Stock held by the holders of the i Discount Debentures,comprising in the aggregate 10% of the issued and outstanding Old SFC-NH Common Stock. 1.138 "13% Discount Debenture' means the 13%r Senior Secured Discount Debentures Due June 15,2009 of SFAC- NH,issued and outstanding under the 13% Discount Debentures Indenture. 1.139 "13'/.%Subordinated Note Claim" means a Claim of a holder of 13'/.% Subordinated Notes, arising under or as a result of the 131/4% Subordinated Notes. 1.140 "13'/4% Subordinated Notes" means the 131/4%Senior Subordinated Notes Due August 15,200; of SFC-NH. issued and outstanding um- the 131/4% Subordinated Notes Indenture. 1.141 "13r/a% Subordinated Notes Indenture" means the indenture,dated June 11, 1999,between SFC-NH and U.S. Trust Company of Texas,N.A.,as trustee,under which the 13'/.% Subordinated Notes were issued. 1.142 "363 Order"means the Bankruptcy Court order approving the Cookie Business Sale. 1.143 "12'/a% Senior Note Claim" means a Claim of a holder of 121/a%Senior Notes,arising under or as a result of the 121/a%Senior Notes. 1.144 "12'/a% Senior Notes" means the 12'/a%Senior Notes Due October 1,2002 of SFC-NH,issued and outstanding under the 12'/a%Senior Notes Indenture. 1.145 "12'/a% Senior Notes Indenture" means the indenture,dated June 11, 1999,between SFC-NH and United States Trust Company of New York,as trustee, under which the IVA%Senior Notes were issued. 1.146 "Unclassified Claims" means,collectively, Administrative Claims and Priority Tax Claims. 1.147 "Unclaimed Distribution Reserve" means the reserve maintained by the Disbursing Agent in accordance with Article V Section D.2. 1.148 "Unofficial Committee" means either(a) the unofficial committee of certain holders of 13'/4% Subordinated Notes, (b) the unofficial committee of certain holders of 13% Discount Debentures,or(c) the unofficial committee of certain holders of 11% Discount Debentures,and "Unofficial Committees" means all of them. C. Rules of Interpretation 1. General In this Plan(a)any reference to a contract,instrument,release,indenture,or other agreement or document as being in a particular form or on particular terms and conditions means the agreement or document substantially in that form or on those terms and conditions,(b)any reference to an existing document or exhibit means that document or exhibit as it may have been or may be amended,modified,or supplemented,(c)unless otherwise specified,all references to Sections,Articles.Schedules, and Exhibits are references to Sections,Articles,Schedules,and Exhibits of or to the Plan,(d)the words "herein"and "hereto" refer to the Plan in its entirety rather than to a particular portion of the Plan,(e)captions and headings to Articles and Sections are for convenience of reference only and are not intended to be a part of or to affect the interpretation of the Plan, and(f)the rules of construction in section 102 of the Bankruptcy Code and in the Bankruptcy Rules shall apply. 2.
