The following is an itemized list of hazardous waste violations that have not been <br /> addresse for Global Materials Management, LLC as of April 17, 2017. <br /> Open violations from August 26, 2016 inspection <br /> Violation #102 - Failed to determine if a waste is a hazardous waste. <br /> At time of inspection: <br /> -the facility accepted at lea t three 55-gallon drums containing undrained used oil filters without first verifying <br /> whether the used oil filtersere completely drained. DTSC staff examined a few oil filters from each drum and <br /> identified at least one undr ined used oil filter from each container <br /> -one 55 gallon drum labele "used absorbents"with a generator name of"williams tank lines" containing used oil <br /> and other hazardous wast identified as non-RCRA by Mr. Kandathil <br /> -one 55 gallon drum of wa a aerosol cans, identified by Mr. Kandathil, from an unknown source <br /> were seen. <br /> -paper oil filters with no me al for scrap metal recycling <br /> -two 55 gallon drums of oil ilters floating in drums of used oil, more suspected throughout the yard due to handling <br /> procedures (Unable to opei i every drum at time of inspection). <br /> According to Mr. Kandathil t is standard business practice to drop an unloaded trailer at his "customers" location. <br /> After dropping an unloaded trailer at the location a full trailer is then transported back to the facility location at 1640 <br /> Broadway, Stockton CA. T e drums are loaded into the trailer by someone other than Mr. Kandathil or his <br /> employees. The drums are not checked before backhauling to the location in Stockton CA. Any person who <br /> generates a waste shall det rmine if the waste is a hazardous waste. Immediately begin making a hazardous waste <br /> determination, make a haz rdous waste determination prior to hauling back to your location. Submit a statement <br /> and supporting documentat on explaining how this waste was managed. <br /> Violation #107 - Failed to repare and implement a contingency plan. <br /> Facility failed to prepare a c ntingency plan. The owner or operator shall prepare a contingency plan designed to <br /> minimize hazards to human health or the environment from fires, explosions, or any unplanned release of <br /> hazardous waste to air, soil, or surface water and immediately implement that plan whenever there is a fire, <br /> explosion, or release of haz rdous waste which could threaten human health or the environment. Immediately <br /> prepare a contingency plan nd submit a copy to the EHD. <br /> Violation #109 - Failed to aintain a hazardous waste contingency plan onsite and submit to required <br /> agencies. <br /> The contingency plan was n t available at the time of inspection. A copy of the contingency plan and all revisions to <br /> the plan shall be maintained at the facility at all times. Copies of the contingency plan shall also be submitted to all <br /> local police departments, fir departments, hospitals and State and local emergency response teams that may be <br /> called upon to provide emer ency services. Immediately locate a copy of the contingency plan for the facility and <br /> submit a copy of the plan to he EHD and to departments that may be called upon to provide emergency services at <br /> the facility. <br /> Violation #113 - Failed to nd generator manifest copies to DTSC within 30 days. <br /> Generator copies of manife t number were not sent to DTSC within 30 days of shipment of hazardous waste, per <br /> Mr. Kandathil. One generato copy available for review, manifest 016140140JJK. The generator manifest copy shall <br /> be submitted to DTSC for e ery shipment on a manifest when California is either the generator state or the <br /> destination or consignment tate. The generator manifest copy shall be mailed to: <br /> DTSC Generator Manife is <br /> P.O. Box 400 <br /> Sacramento, CA 95812- 400 <br /> Immediately mail a copies o all hazardous waste manifests for this location and ensure that copies of all generator <br /> manifests are sent to DTSC tvithin 30 days of shipping hazardous waste. <br /> Page 1 of 8 <br />
