The following is e n itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for Global Materials Management, LLC as of April 17, <br /> 2017. <br /> Open violations from August 26, 2016 inspection <br /> Violation #102 - Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br /> This facility has an Aboveg ound Petroleum Storage Act(APSA) regulated shell capacity of 10,100 gallons. A Spill <br /> Prevention, Control, and C untermeasure (SPCC) Plan was not available on site. All facilities which have an APSA <br /> regulated shell capacity of ,320 gallons or greater shall prepare a written SPCC Plan which meets all of the <br /> requirements of the 40 CF Part 112. This plan shall be certified by a professional engineer in accordance with 40 <br /> CFR 112.3(d). Immediatel prepare a SPCC Plan in accordance with 40 CFR Part 112, which that includes all <br /> aboveground petroleum st rage containers 55 gallons or larger. Submit a copy of the Professional Engineer(PE) <br /> certified SPCC Plan to the HD for review. (This copy will be returned to the facility after review.) A copy shall be <br /> maintained on site at all ti es. <br /> Violation #612 - Plan faile to include secondary containment, diversionary structures, or equip to prevent <br /> discharge. <br /> No secondary containment as observed for the 180+ drums of used oil or the used oil storage in the filter <br /> compactor. A facility shall rovide appropriate containment and/or diversionary structures or equipment to prevent a <br /> discharge. The entire cont inment system, including walls and floor, must be capable of containing oil and must be <br /> constructed so that any dis harge from a primary containment system will not escape the containment system <br /> before cleanup occurs. Im ediately provide adequate secondary containment for all aboveground petroleum <br /> storage containers larger th n 55 gallons. <br /> Violation #618 - Failed to onduct inspections or integrity tests or maintain records for 3 years. <br /> No inspections are being c nducted on the 180+ drums of used oil or the used oil storage in the filter compactor. <br /> Inspections and testing shall be conducted on all aboveground liquid petroleum containers larger than 55 gallons, <br /> including the filter compact r and all 55 gallon drums of oil. Records of these inspections and tests shall be signed <br /> by the appropriate supervis r or inspector and kept on site with the Spill Prevention, Control, and Countermeasure <br /> (SPCC) Plan for a period of three years. Immediately begin necessary testing and inspections for all Aboveground <br /> Petroleum Storage Act regu ated containers and maintain on site with the SPCC Plan. <br /> Violation #619 - Failed to t ain personnel on discharge prevention. <br /> Oil handling personnel were not trained. At a minimum, oil handling personnel shall be trained in the operation and <br /> maintenance of equipment t prevent discharges; discharge procedure protocols; applicable pollution control laws, <br /> rules, and regulations; gene al facility operations; and the contents of the Spill Prevention, Control, and <br /> Countermeasure Plan. Imm diately provide this training to all oil handling personnel and submit a copy of the <br /> training log to the EHD. <br /> Violation #620 - Failed to esignate a person accountable for discharge prevention. <br /> This facility does not have a esignated person for discharge prevention. The Spill Prevention, Control, and <br /> Countermeasure (SPCC) PI n shall designate a person at the facility who is accountable for discharge prevention <br /> and who reports to facility m nagement. Immediately designate a person to be accountable for discharge <br /> prevention and update the S CC Plan to include this information. <br /> Violation #622 - Failure to onduct spill prevention briefing for oil-handling personnel. <br /> Discharge prevention briefin s are not conducted. Discharge prevention briefings for oil handling personnel must <br /> be scheduled and conducte at least once a year to assure adequate understanding of the SPCC Plan for that <br /> facility. Such briefings must ighlight and describe known discharges or failures, malfunctioning components, and <br /> any recently developed prec utionary measures. Immediately schedule and conduct a discharge prevention <br /> briefing, and ensure that the are scheduled and conducted at least once a year. <br /> Violation #706 - Failed to p ovide and maintain adequate secondary containment. <br /> The oil storage drums and c mpactor were observed with insufficient secondary containment. No secondary <br /> containment was observed f r the 180+ drums of used oil or the used oil storage in the filter compactor. All bulk <br /> storage tanks must be provid d with a secondary means of containment for the entire capacity of the tank and <br /> sufficient freeboard to contai precipitation. Immediately provide sufficient secondary containment for this and all <br /> other tanks at this facility. <br /> Page 1 of 2 <br />
