DTSC staff examined a few oil filters from each drum and identified at <br /> least one undrained used oil filter from each container <br /> -one 55 gallon drum label d "used absorbents"with a generator name of"williams tank lines" containing used oil and <br /> other hazardous wastes i entified as non-RCRA by Mr. Kandathil <br /> -one 55 gallon drum of w ste aerosol cans, identified by Mr. Kandathil, from an unknown source <br /> were seen. <br /> -paper oil filters with no m tal for scrap metal recycling <br /> -two 55 gallon drums of of filters floating in drums of used oil, more suspected throughout the yard due to handling <br /> procedures (Unable to op n every drum at time of inspection). <br /> According to Mr. Kandathil it is standard business practice to drop an unloaded trailer at his "customers" location. <br /> After dropping an unloade trailer at the location a full trailer is then transported back to the facility location at 1640 <br /> Broadway, Stockton CA. he drums are loaded into the trailer by someone other than Mr. Kandathil or his <br /> employees. The drums a e not checked before backhauling to the location in Stockton CA. Any person who <br /> generates a waste shall d termine if the waste is a hazardous waste. Immediately begin making a hazardous waste <br /> determination, make a ha ardous waste determination prior to hauling back to your location. Submit a statement and <br /> supporting documentation explaining how this waste was managed. <br /> This is a Class II violation. <br /> 107 CCR 66265.51 Failed to p-epare and implement a contingency plan. <br /> Facility failed to prepare a contingency plan. The owner or operator shall prepare a contingency plan designed to <br /> minimize hazards to humn health or the environment from fires, explosions, or any unplanned release of hazardous <br /> waste to air, soil, or surfac water and immediately implement that plan whenever there is a fire, explosion, or release <br /> of hazardous waste which could threaten human health or the environment. Immediately prepare a contingency plan <br /> and submit a copy to the HD. <br /> This is a Class II violation. <br /> Page 4 of 15 <br />
