k" KLEINFELDER ** Kleinfelder has no control over chemical analysis involved with the project. It is possible that delays could occur; however, Kleinfelder will make every effort to expedite the process. V. AUTHORIZATION Attached to this proposal is our firm's standard "Engineering Services Agreement." Receipt of our agreement signed by the client with the desired services initialed will serve as our firm's formal authorization to proceed on this project. We will, of course, have to approve any requested changes of our scope and contract terms before proceeding. All terms and conditions indicated in this proposal and our attached contract will be considered by both parties to be in effect from the effective date of the executed contract through completion of the project. The proposal will remain in effect for 60 days from the date shown on the proposal and therefore shall be null and void unless our contract has been signed for the work performed. VI. LIMITATIONS Kleinfelder prepared this proposal in accordance with generally accepted standards of care which exist in Northern California at this time. It should be recognized that definition and evaluation of geologic and environmental conditions are a difficult and inexact science. Judgments leading to conclusions and recommendations are generally made with incomplete knowledge of the subsurface conditions present. More extensive studies, including subsurface investigations, may be performed to reduce uncertainties. If the client wishes to reduce the uncertainties beyond the level associated with this proposal Kleinfelder can be notified for additional consultation. No warranty, expressed or implied, is made. Regulations and professional standards applicable to Kleinfelder's services are continually evolving. Techniques are, by necessity, often new and relatively untried. Different professionals may reasonably adopt different approaches to similar problems. Therefore, no warranty or guarantee, expressed or implied, will be included in Kleinfelder's scope of service. During the course of the performance of Kleinfelder's services, hazardous materials may be discovered.
