k" KLEINFELDER <br /> ** Kleinfelder has no control over chemical analysis involved with the project. It is possible that <br /> delays could occur; however, Kleinfelder will make every effort to expedite the process. <br /> V. AUTHORIZATION <br /> Attached to this proposal is our firm's standard "Engineering Services Agreement." Receipt of <br /> our agreement signed by the client with the desired services initialed will serve as our firm's <br /> formal authorization to proceed on this project. We will, of course, have to approve any <br /> requested changes of our scope and contract terms before proceeding. <br /> All terms and conditions indicated in this proposal and our attached contract will be considered <br /> by both parties to be in effect from the effective date of the executed contract through completion <br /> of the project. The proposal will remain in effect for 60 days from the date shown on the <br /> proposal and therefore shall be null and void unless our contract has been signed for the work <br /> performed. <br /> VI. LIMITATIONS <br /> Kleinfelder prepared this proposal in accordance with generally accepted standards of care which <br /> exist in Northern California at this time. It should be recognized that definition and evaluation of <br /> geologic and environmental conditions are a difficult and inexact science. Judgments leading to <br /> conclusions and recommendations are generally made with incomplete knowledge of the <br /> subsurface conditions present. More extensive studies, including subsurface investigations, may <br /> be performed to reduce uncertainties. If the client wishes to reduce the uncertainties beyond the <br /> level associated with this proposal Kleinfelder can be notified for additional consultation. No <br /> warranty, expressed or implied, is made. <br /> Regulations and professional standards applicable to Kleinfelder's services are continually <br /> evolving. Techniques are, by necessity, often new and relatively untried. Different professionals <br /> may reasonably adopt different approaches to similar problems. Therefore, no warranty or <br /> guarantee, expressed or implied, will be included in Kleinfelder's scope of service. <br /> During the course of the performance of Kleinfelder's services, hazardous materials may be <br /> discovered.
