The Honorable John Garamendi <br /> San Joaquin County to enter into a Memorandum of Understanding with the <br /> Department governing inspections of and enforcement actions against hazardous <br /> waste generators in the County. <br /> You raised the question of staffing needs for activities of the Department's <br /> Toxic Substances Control Division. We believe that the additional positions <br /> proposed by the Governor in his Fiscal Year 1984-85 budget will substantially <br /> increase our ability to investigate and correct hazardous waste problems <br /> statewide during the budget year. Hazardous waste management is a dynamic <br /> field, however, and new information on suspected hazardous waste problems is <br /> being received on a regular basis. We expect this information''flow to increase <br /> as the reward program moves into high gear. We will be evaluating our need <br /> for positions beyond the level proposed in the Governor's budget, based on <br /> information as it becomes available. If additional positions are needed, we <br /> will certainly inform the Legislature of our needs. <br /> You raised the issue of jurisdictional ambiguity regarding the Lathrop site. <br /> Under current statutes, the Department makes a case-by-case determination of <br /> what hazardous materials must be considered hazardous waste in situations <br /> involving salvage operations. If the materials are not considered wastes, <br /> the Department would not have jurisdiction. Several other agencies do have <br /> jurisdiction over certain types and means of storing hazardous tuaterials, <br /> e.g. , the Department of Food and Agriculture, the Regional Water Quality <br /> Control Boards, and local agencies .
