STATE OF CALIFORNIA—HEALTH AND WELFARE AGENCY GEORGE DEUKINElIAN, Governor <br /> DEPARTMENT OF HEALTH SERVICES _ <br /> 714/744 P STREET <br /> SACRAMENTO, CA 95814 <br /> (916) 445-1248 <br /> The Honorable John Garamendi MAY 4 04 <br /> Senate Majority Leader <br /> State Capitol, Room 313 <br /> Sacramento, CA 95814 <br /> Dear Senator Garamendi: <br /> Thank you for your recent letter concerning toxic waste problems in the <br /> cities of Manteca, Lathrop, and elsewhere in San Joaquin county. Problems <br /> discovered at the facilities in Manteca and Lathrop have already been <br /> referred to District Attorneys for action, <br /> Lague Sales Company in Lathrop, together with Sacramento Surplus Sales <br /> Company in Sacramento county, are currently under a Temporary Restraining <br /> Order issued by the Superior Court of Sacramento County. This Order was <br /> issued at the Department of Health Services' request, through the Sacramento <br /> County District Attorney, as a result of the Department's initial investi- <br /> gations of these two facilities. A detailed investigation of both facilities <br /> (owned by Robert Lague) is currently in progress in cooperation with the <br /> Sacramento County District Attorney. The San Joaquin County District Attorney <br /> is cooperating fully in this case. We expect that charges will be filed as <br /> a result of these investigations. Enclosed for your information are copies <br /> of the Temporary Restraining Order and associated documents . <br /> Problems discovered at the Gordon Research Company in Manteca have been <br /> referred to the San Joaquin County District Attorney for action. At the Depart- <br /> ment's request, the San Joaquin County District Attorney secured a Preliminary <br /> Injunction against the owner of the facility from the Superior Court* of San <br /> Joaquin County. A detailed investigation of the facility is in progress in <br /> cooperation with the San Joaquin County District Attorney. We expect that <br /> charges will be filed as a result of this investigation. Enclosed for your <br /> information are copies of the stipulated Preliminary Injunction and associated <br /> documents . <br /> We have several other major investigations underway in San Joaquin County. In <br /> addition, inspections have been scheduled at various other site,; which we sus- <br /> pect illegally store or dispose of hazardous waste in the County. Some of the <br /> ongoing and scheduled investigations resulted from our own search efforts and <br /> others from complaints or tips from various sources . Information from any <br /> source is being followed up as rapidly as staff resources will allow. In <br /> addition, we are working with the San Joaquin County Health Department. We <br /> have invited their staff to accompany us on many inspections to further their <br /> training in this area and, as with all major counties, we are encouraging <br />
