Mr. Dave Wood, CEO of Aperio, Inc., will serve as Project Engineer/Geologist and <br /> Project Manager for all further work required to be performed under the Order. Mr. <br /> Wood's resume and Statement of Qualifications are attached as "Exhibit D"and <br /> "Exhibit E,"respectively. <br /> Mr. Wood and Aperio Inc. will formulate and submit the required Chemical <br /> Identification and Disposal Plan to DTSC's specifications, as requested in the <br /> Order. <br /> Other Work Already Performed <br /> At this time, substantial work has been performed on the Property to remove weeds, <br /> shrubbery, and other non-hazardous materials from the site in order to locate and <br /> remove the hazardous substances, as well as to make the Property safe for workers <br /> removing the hazardous materials. <br /> The asbestos siding materials have been removed from the Property. A septic tank <br /> removal permit has been obtained from the County and an air pollution permit has <br /> also been obtained(See attached invoice from Jim Thorpe Oil Co., dated November <br /> 25, 2007, attached as "Exhibit F"). <br /> Additionally, Aperio, Inc. has conducted research, performed a site visit, and <br /> prepared a draft Preliminary Workplan (See attached invoice from Aperio, Inc., <br /> dated October 26, 2007, attached hereto as "Exhibit G"). <br /> Intent to Comply <br /> As a result of the aforementioned activities, I believe the"time-critical"removal <br /> activities outlined in the Order have either been substantially complied with, or are <br /> in the process of getting in to compliance. <br /> The Trust intends to comply fully with the further requirements of the Order. <br /> If you have any questions, please do not hesitate to contact myself or my associate, <br /> Mia Brown, at 209.948.8200. <br /> Very truly yours, <br /> k oTt_ � A <br /> " I(,+-Y� r <br /> Rod A.
