The Property currently is double-fenced with six-foot chain link fencing(See <br /> "Exhibit A" for current fence locations). Both fences are padlocked and contain <br /> signage roughly every twelve feet stating"No Trespassing," "Do Not Enter," <br /> "Construction Site," and "Danger." (See site photo attached hereto as "Exhibit B"). <br /> Both fences are in good structural condition. The inner fence's posts have been <br /> driven into the ground for added stability and safety. <br /> The portion of the Property bordering Union Road currently abuts a road <br /> improvement project site operated by George Reed, Inc., for the City of Manteca. <br /> As a result of the road improvement operations, there is no sidewalk or reasonable <br /> pedestrian access to the front side of the property, as the area between Union Road <br /> and the outer fence enclosing the property is excavated and cordoned off with <br /> pylons. <br /> The property is double-fenced with padlocked chain-link fencing, and the fencing-- <br /> both inner and outer--contains highly visible signage warning against trespassing <br /> and dangerous conditions on the property. There is little to no likelihood of <br /> pedestrian traffic along the property line at this time. Therefore, we believe the <br /> enclosure of the Property substantially complies with the fencing requirements set <br /> forth by DTSC, and adequately protects the public health,public safety, and the <br /> environment. <br /> Posting of Warning Si ns <br /> Section 5.4.2 of the Order requires the posting of specific signage on the Property <br /> fence. Numerous "No Trespassing,""Danger," and"Do Not Enter" signs have <br /> already been placed on both the outer and inner fences enclosing the property. The <br /> specific signage required by the Order has been ordered by Aperio, Inc, and will be <br /> installed as soon as it is received. <br /> As a result, we believe the Property currently contains appropriate signage warning <br /> against trespassing and dangerous conditions on the site sufficient to protect the <br /> public health, public safety, and the environment. The signage required by the <br /> Order will be installed as soon as possible. <br /> Chemical Identification and Disposal Plan <br /> Section 5.4.3 requires a Chemical Identification and Disposal Plan be submitted <br /> within thirty days of the effective date of the Order. Prior to DTSC's involvement, <br /> we had begun clearing the Property under the supervision of the San Joaquin <br /> County Environmental Health Department. To that end, we retained the services of <br /> Aperio, Inc., an Environmental and Geological consulting firm. In accordance with <br /> the County's requirements, Aperio had already prepared a draft Preliminary <br /> Workplan (attached hereto as "Exhibit C") to begin remediation of the site. <br /> 2 <br /> 479425-1 <br />
