Sanding waste in the auto body shop is not being handled as hazardous waste. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately make a hazardous waste determination for the sanding waste generated from the auto body shop, and manage it according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a repeat violation, Class II. The owner or operator shall prepare a contingency plan designed to minimize hazards to human health or the environment from fires, explosions, or any unplanned release of hazardous waste to air, soil, or surface water and immediately implement that plan whenever there is a fire, explosion, or release of hazardous waste which could threaten human health or the environment. Immediately prepare a contingency plan and submit a copy to the EHD, maintain the contingency plan onsite, and train all employees on how to implement the contingency plan. This is a minor violation. 114 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. Manifest numbers 004931454SKS from 11/12/15 were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall submit a legible copy of the missing manifest,with some indication that the generator has not received confirmation of delivery.
