G. Late Filed Claims <br /> 28. The Claims ,listed in Exhibit H were filed after the Bar Date (the "Late Filed <br /> Claims"). In accordance,with the terms of the Bar Date Order,,Rule.3003(c)(2) of the Federal <br /> Rules of Bankruptcy Procedure and Local Rule 3003-1, such Claims should be disallowed. The <br /> Debtors therefore (i) object to the Late Filed Claims and (ii) seek entry of an order disallowing <br /> and expunging the Late Filed Claims in their entirety: <br /> H. Executory Contract Claims <br /> 29. The Debtors are parties to a number of; executory .contracts for,. among other <br /> things, copiers, trucks, computers, etc. Various,entities have filed claims on ,behalf of real <br /> property leases and executory contracts that were in effect on the Petition Date. . The Debtors <br /> have reviewed the contract relating to the Claim listed on Exhibit I (the "Executory Contract <br /> Claims") and have determined that such claim relates to.a contract that has expired by its terms <br /> (the "Expired Contracts"). With respect to the Expired Contract, the Debtors assert that they <br /> have fulfilled all of their obligations pursuant to the terms of the contract and no longer have any <br /> liability with respect to such contract. <br /> 29. The Debtors therefore (i) object to the Executory Contract Claim and (ii) seeks <br /> entry of an order disallowing and expunging the Executory Contract Claim in its entirety. <br /> I. Duplicated in Larger Claim= ; <br /> 30. The Debtors havedetermined determined that some of the Proofs of Claim filed <br /> against the Debtors are,.in fact, asserting claims for a single liability that are duplicated in larger <br /> claims. It is axiomatic that.creditors are not entitled to multiple recoveries for a single liability <br /> against a debtor.
