LINCOLN STREET, STOCKTON, <br /> SAN JOAQUIN COUNTY, CALIFORNIA <br /> I reviewed the Preliminary Investigation and Evaluation Report (PIER) received 12 March 2008, <br /> and the Human Health Risk Assessment (HHRH), received 14 March 2008. The PIER was <br /> submitted by Mr. Kong's consultant Stratus Environmental, Inc. (Stratus), while Exponent, a <br /> subcontractor to Stratus, submitted the HHRH. Both documents were submitted in response to <br /> Cleanup and Abatement Order No. R5-2007-0725 (CAO). I also reviewed Stratus' letter to the <br /> Regional Board Executive Officer, dated 25 March 2008. <br /> The PIER is required by CAO Order #8, which states "Submit results of the site investigation in <br /> a Preliminary Investigation and Evaluation Report (PIER.) in accordance with the approved time <br /> schedule, but no later than 1 March 2008. The PIER shall include recommendations and, if <br /> needed, a second Workplan for additional investigation. If additional investigation is necessary, <br /> the Workplan shall include a time schedule for completing the work and submitting the results." <br /> The HHRA is required by CAO Order #5, and states, "By 16 November 2007, submit a risk <br /> assessment to demonstrate whether the discharges of waste pose unacceptable risks to human <br /> health or the environment. The site-specific risk assessment must use the Office of <br /> Environmental Health Hazard Assessment (OEHHA) toxicity data (California cancer slopes). if <br /> the risk assessment suggests that the discharges of waste pose a threat to human health, the <br /> HHRA shall include a workplan to abate the risk or exposure." <br /> The PIER concludes that the vertical and lateral extent of petroleum hydrocarbons in <br /> groundwater have not been established, and that an addendum to the PIER will be submitted <br /> once approved groundwater monitoring and soil gas wells are installed offsite in S.
