Metal fines generated from metal grinding are being recycled as scrap metal without first <br />determining particle size or hazardous properties. Sandblast waste is being disposed of with the non- <br />hazardous waste soil without first making a hazardous waste determination. Any person who generates <br />a waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal fines and <br />disposing of sandblast waste, make a hazardous waste determination for these wastes, and manage <br />them according the Title 22 hazardous waste regulations. Metal particles 100 microns or smaller must be <br />handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement <br />and supporting documentation explaining how this waste was managed by May 12, 2012. <br />REPEAT VIOLATION <br />135. The follow up to the February 9, 2011 hazardous waste generator inspection was not completely <br />submitted; the disposal of the 55 gallon drum of paint waste which had been on site greater than 90 days <br />was not adequately addressed. The operator of the facility which receives an inspection report shall <br />submit a written response to the local agency within 60 day of receipt of the inspection report, or within a <br />shorter time period as required by the local agency. This response shall include a statement <br />documenting the corrective actions taken by the operator, or which will be taken.
