SUMMARY OF VIOLATIONS CLASS I, CLASS II, or MINOR -Notice to Comply) ROUTINE HAZARDOUS WASTE GENERATOR INSPECTION Class II violations: (108, 135, 605) 108. Metal fines generated from metal grinding are being recycled as scrap metal without first determining particle size or hazardous properties. Sandblast waste is being disposed of with the non- hazardous waste soil without first making a hazardous waste determination. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal fines and disposing of sandblast waste, make a hazardous waste determination for these wastes, and manage them according the Title 22 hazardous waste regulations. Metal particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste was managed by May 12, 2012. REPEAT VIOLATION 135. The follow up to the February 9, 2011 hazardous waste generator inspection was not completely submitted; the disposal of the 55 gallon drum of paint waste which had been on site greater than 90 days was not adequately addressed. The operator of the facility which receives an inspection report shall submit a written response to the local agency within 60 day of receipt of the inspection report, or within a shorter time period as required by the local agency. This response shall include a statement documenting the corrective actions taken by the operator, or which will be taken. Immediately submit all necessary paperwork to complete the response to the 2011 inspection. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
