Used oil: hazardous waste fees. <br /> Existing law requires any person who generates,receives,or stores <br /> used oil to comply with the hazardous waste control law, except as <br /> specified. Existing law also imposes an annual fee upon generators of <br /> I hazardous waste who generate more than 5 tons annually. <br /> This bill would exclude from the calculation of the amount of <br /> hazardous waste generated,for purposes of this fee,used oil removed <br /> from a motor vehicle which is subsequently recycled. <br /> The people of the State of California do enact as follows: <br /> SECTION 1. Section 25250.24 of the Health and Safety Code, is <br /> amended to read: <br /> 25250.24. (a) Except as provided in subdivision (b), any person <br /> who generates, receives, stores, transfers, transports, treats, or <br /> I recycles used oil, unless specifically exempted or unless the used oil <br /> is not regulated by the department pursuant to subdivision (e) of t <br /> Section 25250.1, shall comply with all provisions of this chapter. <br /> (b) Used oil which is removed from a motor vehicle and which is 1 <br /> S <br /> �j subsequently recycled, by a recycler who is permitted pursuant to <br /> .. this article, shall not be included in the calculation of the amount of <br /> hazardous waste generated for purposes of the generator fee <br /> imposed pursuant to Section 25205.5. <br /> O <br /> i <br /> 95 50 <br />
