Proposed program, including methodology, to define the <br /> extent of soil and ground water contamination <br /> (including time table) . <br /> By letter dated 1 September 1988, we requested that USA Petroleum <br /> submit a Preliminary Report(PR) by 30 September 1988, and a <br /> Problem Assessment Report(PAR) by 30 December 1988. On <br /> 26 September 1988, by telephone, Mr. Barry Marcus of Applied <br /> GeoSystems requested an extension to the 30 September date. We <br /> agreed to extend the due date to 17 October 1988, provided no <br /> additional extensions for the PR or PAR were requested. <br /> The requests for submittal of reports are made pursuant to <br /> Sections 25297(b) and 25299.5 of Division 20, Chapter 6.7 of the <br /> California Health and Safety Code, which states that a Regional <br /> Board may take action for the protection of the waters of the <br /> State, and Section 13267 of the California Water Code which <br /> specifies, in part, that: <br /> " (a) A regional board, in establishing or reviewing any <br /> water quality control plan or waste discharge requirements, <br /> or in connection with any action relating to any plan or <br /> requirement or authorized by this division, may investigate <br /> the quality of any waters of the state within its region. <br /> (b) In conducting an investigation specified in subdivision <br /> (a) , the regional board may require that any person <br /> discharging or proposing to discharge waste within its <br /> region or any citizen or domiciliary, or political agency or <br /> entity of this state discharging or proposing to discharge <br /> waste outside of its region that could affect the quality of <br /> waters within its region shall furnish, under penalty of <br /> perjury, those technical or monitoring program- reports as <br /> the board may specify. The burden, including costs, of <br /> these reports shall bear a reasonable relationship to the <br /> need for the report and the benefits to be obtained from the <br /> reports. " <br /> Furthermore, Section 13268 of the California Water Code specifies <br /> that: <br /> " (a) Any person failing or refusing to furnish technical or <br /> monitoring program reports as required by subdivision (b) of <br /> Section 13267, or falsifying any information provided <br /> therein, is guilty of a misdemeanor and may be liable <br /> civilly in accordance with subdivision (b) . <br /> (b) (1) Civil liability may be administratively imposed by <br /> a regional board in accordance with Article 2.5 (commencing <br /> with Section 13323) of Chapter 5 for a' violation of <br /> subdivision (a) in an amount which shall not exceed one <br /> thousand dollars ($1,000) for each day in which the <br /> violation occurs. <br /> (2) Civil liability may be imposed by the superior <br /> court in accordance with Articles 5 (commencing with Section <br />
