I <br /> CALIFORNiA POLLUTION CONTROL FINANCING AUTHORITY <br /> I <br /> PROPOSITION 1C BROWNFIELD REMEDIATION PROGRAM <br /> j CALReUSE PROGRAM EXPANSION PROPOSAL <br /> As of October 15, 2007 <br /> AUTHORIZING STATUTE <br /> for Brownfield cleanup that promotes infill housing development and other related infill development <br /> consistent with regional and local plans..:'—Proposition IC,Health and Safety Code Section 53545(b)(2) <br /> `...the California Pollution Control Financing Authority,in consultation with the Department of Housing and <br /> Community Development,shall administer loans or grants under the California Recycle Underutilized Sites <br /> i (CALReUSE)program established under Article 9(commencing with Section 8090)of Division 11 of Title 4 of the <br /> California Code of Regulations,for the purpose of brownfield cleanup that promotes infill residential and mixed- <br /> used development,consistent with regional and local land use plans."—Senate Bffi 86$ec.29 <br /> EXISTING SITE ASSESSMENT PROGRAM revisions <br /> I. Increase loan term to$300,000 generally,and$500,000 for infill residential and mixed-use <br /> development projects. <br /> a. The maximum loan amount maybe waived and extended by the CPCFA Board if it <br /> is detemvned that the development project has substantial public policy benefits. <br /> IL Modify definition of"Independent Consultant"to track with updated Federal definition. <br /> III.Expand eligible sites to those which have been previously excluded,including: <br /> a. Sites currently listed on the National Priorities List pursuant to the Comprehensive <br /> Environmental Response,Compensation,and Liability Act of 1980,as amended(42 <br /> U.S.C. Section 9605(a)(8)(B)). <br /> b. Sites currently listed for a response action pursuant to Section 25356 of the <br /> California Health and Safety Code. <br /> c. Sites that are,or have ever been,owned or operated by a department,agency,or <br /> instrumentality of the United States. <br /> d. Sites that are hazardous waste facilities subject to the requirements of Article 9, <br /> Chapter 6.5,Division 20 of the California Health and Safety Code. <br /> NEW REMEDIATION PROGRAM <br /> I.
