i <br /> CALIFORNIA POLLUTION CONTROL FINANCING AUTHORITY <br /> 1. 50%-Mot plus 2% <br /> 2. 20%-3%simple interest <br /> 13. 30%- Grant or 0%interest <br /> e. Under the circumstances that the final characteristics of the Development Project <br /> j remain uncertain,the applicant will be eligible to enter into a loan/grant agreement <br /> with provisions to modify the financial terms based on the final Development <br /> Project(Convertible Loan). <br /> f. An application will not be approved,and a loan/grant award may not be drawn <br /> down,until the applicant has submitted an approved Remedial Action Plan by an <br /> Oversight Agency. <br /> g. Loan/grant awards may reimburse eligible costs accrued by the Applicant once a <br /> completed application has been received by a Strategic Partner. <br /> h. The California Pollution Control Financing Authority will upon making a loan place <br /> a lien on the property. <br /> IX. Definition of Default <br /> a. Default on the loan <br /> b. If the Infill Development Project,as described in the Grant and/or Loan <br /> Agreement,is not developed within 6 years of receiving the award; <br /> c. The Infill Development Project no longer meets the qualifications of an Eligible <br /> Project; <br /> d. If the Applicant provides false information as defined in section XI below. <br /> X. Default provisions <br /> a. Borrower repays loan,plus 10%per annum <br /> b. Authority invokes its lien on the property. <br /> c. CPCFA will inform other state agencies—TCAC,HCD,and others—of the default <br /> for their consideration. <br /> d. The Applicant will be ineligible for any future financing under the CALReUSE <br /> program,unless the CPCFA Board waives the penalty. <br /> XI. Reporting Requirements <br /> a. Brownfield Assessment/Remediation Final Report that: <br /> i <br /> Certifies that the Applicant has complied with all Hazardous Waste <br /> Reporting Laws applicable to the Brownfield Infill Project in the manner and <br /> within the time periods required by such Hazardous Waste Reporting Laws. <br /> ii. Certifies that the.Applicant complied with the California Environmental <br /> Quality Act(Public Resources Code sections 21000-21178) and the State <br /> CEQA guidelines. <br /> iii. Includes a final description of the Remedial Work conducted on the <br /> Brownfield Infill Project,including the original and any amended copies of <br /> any reports submitted to the appropriate Oversight Agency. <br /> 5 <br /> The information presented here is preliminary and is made availablefor informational and discussion purposes only.
