i <br /> July 11, 1995 <br /> 95-1104801.80 <br /> Mr. David Chinchen <br /> Subject: LETTER REPORT - Records Review of Chevron U.S.A. <br /> 2409 East Main Street <br /> Stockton, California <br /> Page 2 <br /> ■ City of Stockton Community Development Center, Permit Center; and <br /> ■ County of San Joaquin, Assessor's Office. <br /> The information and records gathered during this investigation revealed the following <br /> information regarding Chevron: <br /> ■ The property was leased to Standard Oil Company of California (now referred <br /> to as Chevron) in November 1954 (refer to Attachment 1 for lease agreement); <br /> ■ The lease agreement has the following key points: <br /> "Lessee will, at its expense,'make all repairs that may become necessary <br /> on the leased premises during the term of the lease, and upon the <br /> expiration of the term of this lease...Lessee will return the leased premises <br /> to Lessor in good condition..." <br /> "Lessee agrees that it will indemnify and save Lessor harmless from any <br /> and all liability, damage, expense...arising from injury to property arising <br /> out of Lessee's use of the leased premises." <br /> ■ The City of Stockton Fire Department did not require permitting of the USTs on <br /> the property; and <br /> ■ All permits and tax information gathered for the property show Chevron as the <br /> 'owner"/operator of the property (refer to Attachment 2). <br /> I <br /> Conclusion <br /> The lease agreement indicates that Chevron is responsible for the UST and for any <br /> remedial action necessary due to environmental impacts associated with the UST, with other <br /> USTs-owned/operated by Chevron (which have been removed from the property) and other <br /> Potential release( )s during their operation. Sherman S. Hinaman Trust was not involved in day- <br /> to-day operation of Chevron, and had no knowledge that Chevron had left a waste oil UST in <br /> place- and conducted no investigation to soil and groundwater for possible impacts. We <br /> recommend that Sherman S. Hinaman Trust contact Chevron for the removal of waste oil UST <br /> and associated investigation and for further investigation of other potential source areas such <br /> as UST and hydraulic lift areas. If necessary, Chevron should conduct remedial action to restore <br /> the property to its former condition prior to their occupation. <br />
