All buildings,improvements,equipment,and other <br /> property constructed, installed or placed on the Premises by SHELL or acquired by SHELL, at <br /> any time during the continuance of this or any previous Lease or any tenancy thereafter; shall be <br /> and remain SHELL's property and SHELL shall have the right to remove any or all of the same <br /> Z <br /> rom the Premises at any time during and within sixty (60) days after any termination of this <br /> Lease or any tenancy thereafter, and LESSOR agrees, that if SHELL elects not to remove any <br /> or all of the same, title to same shall pass to LESSOR WITHOUT ANY WARRANTY, <br /> EXPRESS OR IMPLIED, AS TO MERCHANTABILITY, CONDITION AND FITNESS FOR <br /> t �E THEREOF FOR ANY PURPOSE. At any termination of this Lease or any tenancy <br /> thereafter, SHELL shall surrender the Premises to LESSOR, subject to ordinary wear and tear <br /> and to SHELL's rights under articles 9 and 17. Any holdover by SHELL after any termination <br /> c ' :his Lease shall create no more than a month-to-month tenancy at the rent and on all other <br /> :icable provisions hereof. If forfeiture or termination of this Lease is permitted by law for <br /> "LL's default, LESSOR shall not be entitled to declare any such forfeiture or termination <br /> ass LESSOR has given SHELL notice of such default and SHELL has failed to remedy same <br /> . ;in thirty (30) days after receipt of such notice. <br /> IS. Warranty of Tide. LESSOR covenants that LESSOR is well seized of and has <br /> 0^^d right to lease the Premises, will warrant and defend the title thereto, and will indemnify <br /> 'LL against any damage and expense which SHELL may suffer by reason of any lien, <br /> - mbrance, restriction or defect in the title to or description herein of the Premises, other than <br /> uch item created or caused by Shell, If at any time LESSOR's title or right to receive rent <br /> nder is disputed, or there is a change of ownership of LESSOR's estate by act of the parties <br /> erasion of law, SHELL may withhold rent thereafter accruing until SHELL is furnished <br /> satisfactory to it as to the party entitled thereto. <br /> 19. Underground Storage Tana. <br /> (a) The parties acknowledge that SHELL is the owner and operator of the <br /> mround storage tanks now located or hereafter installed by SHELL on the Premises (the <br /> (b) SHELL shall comply with all statutory and regulatory obligations relating <br /> ownershiip, use, operation, maintenance, or removal of the USTs. <br /> (c) SHELL shall not install or replace any underground storage tanks without <br /> staining LESSOR's prior written consent,which consent shall not be unreasonably withheld. <br /> (d) SHELL shall notify LESSOR in writing of any and all reportable releases <br /> the USTs within the time allowed to notify the appropreate governmental authorities of such <br /> (e) At the request of LESSOR, SHELL shall provide LESSOR with copies <br /> i correspondence between any government agency and SHELL and between any consultant <br /> ''�3 wpd Page 6 <br />
