After reviewing your claim application to the Cleanup Fund, we find that the following additional information is needed to determine your eligibility for placement on the Priority List: • On page one (1) of your claim application clarify claimant's name (Dung Phan and Nhuan Le) and tax identification number. You have listed individual's names but provided a federal tax I.D. number. Claimant's name and tax I.D. number must match (same name as listed on taxes). If claimant& claimant's spouse are applying together as individuals, it's okay to list claimant's name on claim application under both names (or just husband's name)if they file taxes jointly as individuals.' It appears claimant(s) may be using various names. Please clarify how many different people are listed below. Their relationship to Property Owner,UST Owner and/or UST Operator should be clarified on page three (3) of your claim application if appropriate. If various names/spelling are used for claimant(s), please clarify in writing and provide a copy of driver's license(s)with a signed/dated statement(s) under penalty ofpeijury that they are the same entity using the various names. 1. The Permit to Operated (dated 1/1/05-12/31/05) is issued to Phan, Nhuan T and Phan, Dung 2. The same permit (1/1/05-12/31/05) lists the Tank Owner as Le, Nhuan T& Phan. Dung T, 3. San Joaquin County's letter (dated 2/9/05)names the responsible party as Dung Thanh & Nhuan Thi Phan. • On page six (6) of your claim application, under Financial Responsibility, Mechanism(s), did you intend to check box number eight (8) (State Fund) as Mechanism Type (and as indicated on the Certification of Financial Responsibility form), instead of box number six (6)Insurance Coverage? If you use the Fund as a mechanism, you must use an additional mechanism for the deductible, and you may only use one of two mechanisms in conjunction with the Fund mechanism: 1)Letterfrom Chief Financial Of or 2) Certificate of Deposit. Refer to pages 17-22 of the Financial Responsibility Guide for description of approved financial responsibility mechanisms. If you use Insurance,provide a copy of your insurance policy. ' Claimant is advised that an eligible claimant must have either owned or operated the subject leaking UST, is the responsible party directed to undertake corrective action for the unauthorized release by the local regulator and is the party paying for the costs of cleanup.
