Weber Street, Third Floor <br /> Stockton, California 95202 <br /> Subject: Vapor Extraction Test at Tosco 76 Service Station #5886, 2701 March Lane, Stockton, <br /> California. <br /> Mr Rowe: <br /> At the request of Tosco Marketing Company (Tosco), Environmental Resolutions. Inc. (ERI) scheduled <br /> a vapor-extraction feasibility test to be performed on November 16, 1998 at the subject site and <br /> provided notifications to your office and the San Joaquin Valley Unified Air Pollution Control District <br /> (ERI, November 9, 1998). Your office provided conditional approval to perform the work (dated <br /> November 10, 1998). These conditions are generally acceptable except for the statement "consultant <br /> has waiver for public participation per K. Romstad (ERI)". Therefore, to insure meeting each <br /> requirement the test had to be canceled. Based on ERI's discussions with personnel of the San Joaquin <br /> Valley Unified Air Pollution Control District, it is our understanding that vapor extraction tests limited <br /> to no longer than 5 days may be performed and are exempt from Air Pollution Control District (APCD) <br /> permitting provided appropriate abatement is utilized (i.e. blower and carbon as proposed) and <br /> notification is provided. It is ERI's further understanding feasibility testing does not require public <br /> participation notice and therefore ERI and Tosco have not obtained a "waiver" from any other agency. <br /> However, if necessary, ERI and Tosco respectfully request your agency issue a waiver to public <br /> participation to allow ERI to perform the vapor extraction feasibility test. <br /> Furthermore, neither ERI or Tosco representatives have received the approval letter for the "Site <br /> Assessment" work plan referenced in your letter to have been approved several months ago. <br /> Therefore, we request your office forward copies of the letter to ERI's Novato office and Mr. Ed <br /> Ralston of Tosco in Roseville, California. <br /> ERI and Tosco further request you office assist in obtaining access to the property adjacent to the <br /> western property boundary of the subject site at 2727 March Lane, Stockton, California.
