March Lane, #360 March 11, 2009
Stockton, CA 95219
The EHD has recommended that ConocoPhillips consider performing groundwater extraction
from the City of Stockton street, but they are concerned with the safety of their workers. The
EHD has .suggested that the work be performed during non-business .hours to alleviate
problems that may occur during business hours.
The.EHD requests that you negotiate a property access agreement with ConocoPhillips so the
investigation and clean up of the plume of MTBE contaminated groundwater can proceed. The
EHD is willing to meet with you in an effort to reach an agreement.
Please be advised that under California Water Code Sections 13267 and 13304, enforced by
the California Regional Water Quality Control Board (CRWQCB), all persons owning property
underlain by contaminated ground water may be held responsible for investigation and cleanup
of the contamination. If you do not reach an agreement with ConocoPhillips, the CRWQCB may
require you to conduct the necessary investigation on your property:
If I can be of assistance in this matter or you have any questions, please contact me at (209)
468-3449.
Margaret Lagorio, REHS
Program Coordinator
Cc: Ted Moise, Conoco Phillips,76 Broadway, Sacramento, CA 95818
Lee Ignatowicz, Stantec Consulting Corporation, 3017 Kilgore Road, Ste. 100, Rancho
Cordova, CA 95670
Darrel Eppler, 2701 W.
