Any person who generates a waste <br />shall determine if the waste is a hazardous waste . These cans were removed from inside of the latex paint <br />container at the time of inspection. A hazardous waste determination was made, and these containers were placed <br />into an appropriate hazardous waste container. This was corrected at the time of inspection. <br />This is a Class II violation. <br />113 <br />CCR 66262.23(a)(4) Failed to send generator manifest copies to DTSC within 30 days. <br />Based on the reviewed manifest tracking log, generator copies of manifest numbers: 000118962DAT, <br />000118963DAT, 000118964DAT, 000118965DAT, 000118967DAT, 000118968DAT, 000105322DAT, <br />000105325DAT, 000118032DAT, 000118035DAT, 004622668SKS, and 004765208SKS were not sent to DTSC <br />within 30 days of shipment of hazardous waste. The generator manifest copy shall be submitted to DTSC for every <br />shipment on a manifest when California is either the generator state or the destination or consignment state. The <br />generator manifest copy shall be mailed to: <br />DTSC Generator Manifests <br />P.O. Box 400 <br />Sacramento, CA 95812-0400 <br />Ensure that manifest copies are sent to DTSC within 30 days of shipping hazardous waste . <br />This is a Class II violation. <br />303 <br />CCR 66265.33 Failed to maintain all Communication or alarm systems, spill control, or decontamination equipment. <br />Oily liquid was observed inside two spill pallets, located inside an outdoor storage container, which was labeled as " <br />household batteries only". All facilities shall be equipped with an internal communication or alarm system, a device <br />capable of calling outside emergency help, spill control equipment, and decontamination equipment at all times. <br />Immediately maintain all spill control equipment, as appropriate, provide proof of correction to the EHD. <br />This is a Class II violation. <br />403 <br />CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />One black 55 -gallon metal container storing medical hazardous waste, was observed with a lid which was not <br />closed. No waste was being added or removed to this container at the time of inspection. All hazardous waste <br />containers shall be closed at all times except when adding or removing waste. This container was closed, as <br />appropriate, at the time <br />of inspection.
