Wit in 120 days of the effective date of this Permit, the Permittee shall <br />submit to the Department a Current Conditions Report and a Workplan for a <br />RCRA Facility Investigation ("RFI Workplan") addressing SWMU Nos. 10 <br />and 21 and AOC Nos. 3, 4, and 5 only. The Current Conditions Report and <br />RFI Workplan shall be developed in a manner consistent with the Scope of <br />Wok for a RCRA Facility Investigation provided by the Department. The <br />Department will review the Current Conditions Report and RFI Workplan and <br />notify the Permittee in writing of the Department's approval or disapproval, <br />including any comments and/or modifications, in accordance with the Section <br />IV.f of this permit. <br />b. A s cific schedule for implementation of all activities shall be included in the <br />RFI Workplan (e.g., submittal of phase 2 workplan, submittal of RFI <br />Re rts, etc.). <br />C. The Permittee shall submit a RFI Report to the Department in accordance with <br />the schedule contained in the approved RFI Workplan. The RFI Report shall <br />be developed in a manner consistent with the Scope of Work for a RCRA <br />Facility Investigation. If there is a phased investigation, separate RFI <br />Ref orts for each phase and a summary report that summarizes the findings <br />from all phases of the RFI must be submitted to the Department. The <br />Department will review the RFI Report(s) and notify the Permittee in writing <br />of tie Department's approval or disapproval, including any comments and/or <br />mo ifications, in accordance with Section IV.F of this permit. <br />a. The Department will require a Corrective Measures Study if the RFI Report <br />a& ressing SWMU Nos. 10 and 21 and AOC Nos. 3, 4, and 5 reveal <br />cor taminant concentrations that exceed current health -based action levels <br />an/or if the Department determines that the contaminant releases pose a <br />not ntial threat to human health and/or the environment. <br />b. Wi hin 45 days after the Permittee receives a written request from the <br />De artment, the Permittee shall submit a CMS Workplan to the Department. <br />The CMS Workplan shall be developed in a manner consistent with the Scope <br />of Nork for a Corrective Measures Study provided by the Department. The <br />De artment will review the CMS Workplan and notify the Permittee in <br />wr ting of the Department's approval or disapproval, including any comments <br />an /or modifications, in accordance with the Section IV.F of this permit. <br />C. 7Permittee shall submit a CMS Report to the Department in accordance <br />wi h the schedule contained in the approved CMS Workplan.
