Development Committee June 28, 1989 SA-87-20 Page 2 4. The proposed sign shall meet the requirements of Section 9-3603 of the Planning Title . 5 . All profits and income over expenses of any agricultural use on the cemetery property shall be applied to the operating and maintenance expenses of the cemetery. 6 . A perpetual care trust fund shall be established. Each burial fee shall include a minimum charge of $150 . 00 to be set aside and put in the perpetual care trust fund . 7 . The Lodi Muslim Mosque and The Islamic Center of Stockton shall ensure that sufficient funds are available to maintain the Islamic Cemetery. In the event that the Islamic Cemetery does not become self-�-upporting, the Lodi Muslim Mosque and The Islamic Center of Stockton shall bear the cost of main- taining the cemetery in perpetuity . 8. Security for faithful performance of the continuing operation and maintenance conditions of this approval shall be submit- ted to the County in the form of a Bond, Letter of Credit, or Certificate of Deposit, or any other security acceptable to the Board of Supervisors , in an amount not less than $35 , 000 . Said security will be provided by February 7 , 1990 . The Planning Division will review and may increase the amount of the fund in three years to reflect any cost increase . In lieu of this security, an endowment care fund may be estab- lished in the amount of $ 35 , 000 , subject to the approval of the Planning Division. 9 . The Islamic Cemetery, the Lodi Muslim Mosque , and The Islamic Center of Stockton shall comply with all provisions of the attached resolutions and letters dated April 13 , 1987 ; July 6, 1987 ; and July 24, 1987 . In the event of any conflict in the terms of these conditions , and the statements _n the attach- ments , these conditions shall prevail . 10. By their signatures the Islamic Cemetery of California , the Lodi Muslim Mosque , and The Islamic Center of Stockton agree to all the above conditions . A copy of the signed conditions shall be submitted to the Planning Division on or before July 10 , 1989 .
