As you know, the, purpose of adopting the Airport <br /> Land Use Commission Airport Area of Influence Boundary Map, was an <br /> attempt to alleviate potential noise and safety problems within the <br /> Airport environs both for people on the ground as well as for aircraft <br /> utilizing the Stockton Metropolitan Airport. <br /> Since the project area includes the Stockton Metropolitan Airport <br /> Area of Influence Boundary, and is located in an area which is sub- <br /> jected to overflight and possible noise, the County Department of <br /> Aviation, after consultation with the County ' s Airport Noise Study and <br /> Land Use Planning Consultants (McClintock, Becker & Associates ) , is <br /> recommending that as a minimum, the San Joaquin County Planning <br /> Division require the Applicant to grant and employ three important <br /> measures to protect the interests of the County (as Airport proprietor ) , <br /> and the interests of future residents of the subject property, as <br /> follows : <br /> ( 1 ) Deed of Avigation and Hazard Easement. The proponent should <br /> grant to the County a perpetual , assignable easement permitting <br /> overflight of the property by aircraft, together with any <br /> inherent noise or other emissions which are inherent in the <br /> operation of aircraft. This easement should be recorded as a <br /> deed restriction flowing in perpetuity to all successor <br /> property owners . A draft form of such an easement is attached. <br /> (2 ) Airport Noise Disclosure. The proponent should agree to imple- <br /> ment the procedures of the California Real Estate Association <br /> concerning the notice and disclosure of the fact that the sub- <br /> ject property is in the vicinity of an airport and is exposed <br /> to significant noise levels . Attached is a disclosure .form <br /> which should be read and signed by all property owners at the <br /> time of closing of escrow. Prospective project tenants should <br /> also read and sign the disclosure as a condition of tenancy . <br /> ( 3 ) Structural Acoustical Performance. The County should be <br /> encouraged to require the proponent and his/her architect to <br /> incorporate structural and architectural measures to assure <br /> good acoustical performance of any permanent structures at the <br /> project site. The incorporation of such design specifications <br /> should normally be preceded by an on-site acoustical evaluation <br /> to assist the project architect. Attached is a paper entitled, <br /> Recommended Building Requirements , which sets forth measures <br /> which can be employed to yield excellent structural noise level <br /> reductions . <br /> All consideration given to the issues of compatible land uses in the <br /> vicinity of the Stockton Metropolitan Airport, should help to relieve <br /> future conflict between this communities ' Airport and its surrounding <br /> environs . <br />
