1 . 3 Prior Notice of Commencement of Work At least 72 hours prior to the commencement of activities on Owner' s Property pursuant to this agreement, STTC shall provide facsimile and telephone notice to Owner and to affected tenants of Owner, detailing the work to be conducted on Owner ' s Proerty, the equipment to be used, and the sort of access t the property that is required. Owner ' s current tenants on the affected property are listed on Exhibit "B" attached hereto. 2 . Conduct of Operations) 2 . 1 No Undue Interference STTC shall perform all activities on Owner ' s Property in such a manner as not to interfere unduly with or disrupt the normal operation of activities and or any future and upcoming development on the property, and so as not to endanger the health, safety, or welfare of employees, agents, clients, tenants, for others present on Owner' s Property. 2 . 2 Changed Uses of Owner' s Property In the event that Owner' s or its tenant ' s use of Owner' s Property changes in a man er inconsistent with the location of one or more of the installed monitoring wells, then the STTC shall close and abandon such wells in accordance with all applicable federal, state or local governmental requirements. Thereafter the parties shall work together in good faith to determine acceptable locations for replacement wells that will meet the Water Board' s requirements, that wil not interfere unduly with anticipated operations on Owner' s Property, and that will minimize relocation costs for the STTC as much as possible. Any such well removal and replacement of monitoring wells shall be done at the STTC sole cost and expense. 2 . 3 Removal and Restoration STTC shall remove any necessary material and equipment from Owner' s Property promptly upon completion of the necessary work, and shall restoreOwner' s Property to its condition prior to the conduct of such work.
